Annual Health and
Safety Conference
2010!

We
hope you join us for the 2010 WorkSafeNB Annual Health and Safety
Conference October 17-19 at the Delta Beauséjour in Moncton. We
know Mario DeMello of Borderless Solutions Inc.
of Halifax will be attending. DeMello's name was drawn from
all those E-News readers who sent in suggestions for workshop
topics and speakers. We want to thank all our readers for some
great suggestions - we appreciate your input.
Day
of Mourning remembers workers killed and hurt on the
job |
On September 22, 1971, Pauline Farrell
set the table for two, like she always did, before heading
to bed. Her husband, Bill Kelly, was working an overnight
shift for NB Power and was scheduled to be home in time for
breakfast.
Tragically,
Farrell was awoken at 3:50 a.m. to devastating news that her
husband was killed in an explosion at work. "The priest came to
tell me what happened, and when he saw the two place
settings, his eyes welled up with tears," Farrell said. "I
was nearly six months pregnant, and my whole life came
crashing down when I heard that Bill was dead.
"
On
April 28, Farrell will be attending her local Day of
Mourning ceremony in Moncton. She said she attends
the memorial event every year to honour her late husband.
Her daughter, who never met her father, attends the Saint
John ceremony.
"This
is an important event that every New Brunswicker should go
to," Farrell said. "We need to gather together as a
community to honour all workers killed, the same way we do
for our veterans on Remembrance Day." more

Nobody needs to explain the
importance of workplace health and safety to Roy
Silliker.
Having
spent the last 22 years working in the heavy construction
industry, Silliker has seen far too many workplace injuries.
Wanting to stop these injuries led to his current position
as the general manager of the New Brunswick Construction
Safety Association (NBCSA) in
Miramichi.
And
with North American Occupational Safety and Health
(NAOSH) Week just around the corner (May 2-8), he finds
himself kicking it into high gear. NAOSH Week activities
include a series of breakfasts featuring health and safety
discussions for JHSC members across New Brunswick, and
Silliker is one of a select few who have attended every one
of them. more

Aurèle
Brun,
of Aldouane, N.B. pleaded guilty on March 2, 2010 to a
charge of defrauding WorkSafeNB of more than $5,000, by
failing to declare earnings between July to December 2006.
Brun was ordered to pay restitution of $8,210.85 and was
sentenced to two years
probation.

Q:
I would like to
clarify coverage for contractors. I am under the
understanding that if we have a contractor (us being the
principal) who has less than three employees, we are
responsible for his coverage. Please clarify if this is the
case if the contractor is doing contract work with a
duration of one week or less.
If
there is a duration of time applicable, how does it work if
the contractor took up to three days to complete the job but
because of necessary parts on back-order, etc., the three
days were spread over four
weeks.

A: The "less than
three" and less than "five days" only applies to out
of province contactors.
In New
Brunswick, employers' compensation coverage is only
mandatory if an employer has three workers usually employed.
(Mandatory Coverage - Employers having three or more
workers, full or part-time, must register for coverage.)
Individuals who are self-employed are generally not covered
by WorkSafeNB. However, in cases where self-employed
individuals are under contract, they become workers of the
principal contractor and compensation coverage is provided
through the principal contractor.The only exception is the
fishing industry, which must register when 25 or more
workers are employed.
When fewer than
three workers are employed, voluntary coverage may be
requested. Employers applying for volutnary coverage must
have at least one worker with a minimum of $3,000 in
assessable earnings. Payment of the assessment must
accompany the application. Exception: An employer with fewer
than three workers working exclusively for one principal
will not be granted voluntary coverage. The principal is
responsible for all such subcontractors. more
